1. Introduction and Acceptance
These Terms and Conditions govern the use of services provided by nimbusnoh, a travel agency registered in Singapore. By booking our services or using our website, you agree to be bound by these terms.
Please read these terms carefully before making any booking. If you do not agree with any part of these terms, you should not use our services.
2. Definitions
- "Company," "We," "Us" refers to nimbusnoh
- "Services" means winter travel planning, booking, and related services
- "Client," "You" refers to the person or entity booking services
- "Journey" refers to the travel arrangements booked through our services
- "Supplier" refers to lodges, operators, airlines, and other service providers
3. Booking and Payment
3.1 Booking Process
All bookings must be made through our authorized channels. A booking is confirmed only upon receipt of our written confirmation and required deposit payment.
3.2 Payment Terms
- Deposit: 30% of total journey cost due at booking
- Balance: Due 60 days prior to departure
- Currency: Singapore Dollars (SGD) unless otherwise specified
- Methods: Bank transfer, credit card (processing fees may apply)
3.3 Price Changes
Prices are subject to change until booking confirmation. After confirmation, prices may only be adjusted for significant currency fluctuations, fuel surcharges, or government-imposed taxes beyond our control.
4. Cancellation and Refunds
4.1 Cancellation by Client
- More than 90 days before departure: 25% cancellation fee
- 60-90 days before departure: 50% cancellation fee
- 30-59 days before departure: 75% cancellation fee
- Less than 30 days before departure: 100% cancellation fee (no refund)
4.2 Refund Processing
Approved refunds will be processed within 30 business days of cancellation notification. Refunds are subject to supplier cancellation policies and any non-refundable deposits paid to third parties.
4.3 Travel Insurance
We strongly recommend comprehensive travel insurance covering cancellation, medical emergencies, and evacuation. Insurance premiums are typically non-refundable.
5. Travel Documents and Requirements
Clients are responsible for obtaining valid passports, visas, and any required health documentation. We provide guidance but cannot guarantee visa approval or entry permission.
Passport validity requirements vary by destination, typically requiring at least six months validity beyond travel dates. Failure to obtain proper documentation resulting in denied travel will be treated as voluntary cancellation.
6. Health and Fitness Requirements
Clients must accurately disclose any medical conditions that may affect their ability to participate in booked activities. Certain journeys require specific fitness levels, which we will clearly communicate during consultation.
We reserve the right to refuse participation if, in our or our suppliers' judgment, a client's health or fitness poses safety concerns. In such cases, standard cancellation fees apply.
7. Our Responsibilities and Limitations
7.1 Service Provision
We act as intermediaries between clients and service suppliers. While we carefully select partners and provide comprehensive support, we do not directly control supplier operations.
7.2 Liability Limitations
Our liability is limited to the total amount paid for services. We are not liable for supplier failures, force majeure events, or consequences of client decisions contrary to our recommendations.
7.3 Force Majeure
We are not responsible for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, epidemics, war, terrorism, or severe weather conditions.
8. Client Responsibilities
- Arrive at designated meeting points on time
- Follow instructions provided by guides and operators
- Respect local laws, customs, and environmental regulations
- Maintain appropriate travel insurance throughout the journey
- Inform us immediately of any issues or concerns during travel
- Behave respectfully toward other travelers, guides, and local communities
9. Changes and Amendments
We reserve the right to modify itineraries due to weather, safety concerns, or operational requirements. We will make reasonable efforts to provide equivalent alternatives when changes are necessary.
Significant changes will be communicated promptly. Clients may cancel without penalty if major changes are unacceptable, receiving a full refund of payments made.
10. Complaints and Dispute Resolution
Complaints should be raised immediately with guides or operators to allow resolution during travel. Formal complaints must be submitted in writing within 30 days of journey completion.
We will investigate complaints thoroughly and respond within 30 business days. Disputes that cannot be resolved through negotiation will be subject to Singapore law and the jurisdiction of Singapore courts.
11. Intellectual Property
All content on our website, including text, images, logos, and itinerary descriptions, is protected by copyright. Unauthorized reproduction or commercial use is prohibited without written permission.
12. Privacy and Data Protection
We handle personal data in accordance with our Privacy Policy and Singapore's Personal Data Protection Act. By using our services, you consent to data processing as described in our Privacy Policy.
13. Governing Law
These Terms and Conditions are governed by Singapore law. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of Singapore courts.
If any provision of these terms is found invalid, the remaining provisions remain in full effect.
